Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

Accounts

When you create an account with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service.

You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of THE GRIND HOUSE and its licensors.

You further acknowledge and agree that THE GRIND HOUSE shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is a material we will try to provide at least 24 hours notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

Facility Rules

1. Equipment – Members are required to use their own equipment such as gloves, bats, batting gloves, etc. Programs may offer the use of training equipment to help the player in their training. The Grind House LLC will not be held responsible for any lost or broken items of the athlete.
2. Booking Policy
   1. On the booking site, members can see up to 14 days in advance to book their session(s).
   2. Members have up to 4 hours prior to cancel their session by accessing their account on the website.
   3. If the session is not canceled within the 4 hour period, there is NO cancellation fee, but the customer will lose that appointment dependent on the program that they are in and its allowed appointments.
   4. If a customer shows up without an appointment, he or she will be asked to book for an available time slot.
   5. Members must only book for the program they have paid for. If the booking is incorrect, it will be removed from the system and asked to re-book.
   6.  Members have the ability to book 1 hour in advance for a session.
3. Tardiness – Customers who show up after 15 minutes of their scheduled appointment will be asked to wait until the next available session. If there are no available sessions, the customer will be asked to book for another time/day for their session. We please ask customers to show up at least 5 minutes prior to their scheduled session to achieve the proper warmup.                           
4. No-Shows – If the customer does not show up for their appointment without any contact with the facility and staff, there will be a no-show recorded in the system. After the 2nd no-show recorded, the customer’s account will be frozen and will lose any future appointments scheduled. The customer must contact the facility to regain access to their account.
5. Hours of Operation – Dependent on the program selected, hours of operation may differ. Please revert to your program’s guide or ask your program director. Program hours are listed on the booking site. If in the case, the specific program, or The Grind House facility needs to shut down, members will be given 48-72 hours of notice and The Grind House and program instructors will do their best to add extra appointment slots for time missed.
6. Recurring Payments – All memberships are 4 weeks and will renew the same day as the first booking of the program purchased as stated of the membership agreement signed by the card holder.
7. Cancellations – In order to cancel a membership, you must attempt to contact the facility’s support email or submit the support form. Memberships that have been renewed without any notice of cancellation and or already contain an appointment will only receive credit for future use. The Grind House LLC does not pause memberships once the term has begun. In the result of injury or illness to the member, it will be up to the discretion of The Grind House LLC and the instructors on what to credit.
8. Refunds – Refunds are subject to The Grind House LLC’s approval. Members must email support@grindhousebaseball.com at least 24 hours prior to a charge. If this is not done by the member within the time frame and the system charges the member’s card, the member may only receive credit for future use at the facility. If a refund is the only option, the member may be subject for a 5% transaction fee.
